H-2B VISA

Overview

The H-2B visa allows U.S. employers to bring foreign nationals to the United States to fill temporary non-agricultural jobs. It is commonly used in seasonal or peak-load industries such as hospitality, landscaping, construction, and seafood processing.

Key requirements

The employer must show that the need for workers is temporary (one-time, seasonal, peakload, or intermittent), that there are not enough U.S. workers available, and that hiring foreign workers will not adversely affect the wages and working conditions of U.S. workers. The category is subject to an annual cap, and the process includes a temporary labor certification from the Department of Labor.

How Do Law can help

We help employers establish their temporary need, navigate the labor certification and recruitment requirements, and prepare petitions for timely filing — and we advise workers on their rights and obligations under H-2B status.
